    U.S. SENATE TO CONSIDER IMMIGRATION LEGISLATION

    Background. Democratic and Republican Senators, along with the Bush Administration, are currently negotiating compromise immigration reform legislation which could be considered on the floor of the U.S. Senate beginning the week of May 14. Should these negotiations falter, the Democratic leadership could choose to bring the STRIVE Act, or a similar bill, to the floor for immediate consideration. It is important that you contact your Senators in the next few days and ask for their support for a just and humane immigration reform bill.

    USCCB Position. The United States Conference of Catholic Bishops (USCCB) and other organizational members of the Justice for Immigrants (JFI) Campaign are working to ensure that any compromise immigration legislation includes the principles set forth by the U.S. bishops. Any legislation which would warrant USCCB support would include:
    1. a legalization program for the undocumented which includes family unity and a realistic path to citizenship;
    2. a new worker program with worker protections and a path to citizenship; and
    3. the preservation of family reunification as a cornerstone of our immigration system and the elimination of family backlogs and waiting times.

    I did not get an approval for the 485 so was thinking what the process was here. Am I not supposed to be getting an approval notice in the email before the "Card Ordered" message came through ? I hope everything is over now, it was a long 51/2 years wait and just when you loose hope in the whole process this message turns up in my Inbox. I love this site and will continue to support it in whatever manner I can

    I would like to clarify a few things possibly misunderstood lately.

    Firstly, IV core and all volunteers are fully aware and DO acknowledge that CIR, as we know today, is headed to its grave. Unless something new happens of political significance, all experts have ruled of reform before elections in November.

    Secondly, IV core never has and never will bet on one bill. We have said that before and we say that again. CIR is not the only bill we are looking at for passing reforms that provide relief to legal hi-skills immigrants. We will look at the next opportunity to introduce our provisions in and are not going to sit around and wait for elections to come an go. And that means any bill. PACE, SKIL, immigration related, competitiveness related - ANYTHING.

    Thirdly, no matter with IV or QGA does, or anybody does, a bill related to immigration is not going to be tabled on the House or Senate floor BEFORE CIR is officially dead. As long as CIR is even slightly in the picture, an immigration legislation will not be scheduled on Senate or House. That simply is not going to happen even if we hire 100 lobbyists and send million webfaxes. CIR has to go away first before Bill Frist or John Boehner puts another immigration bill on the schedule.

    However, if CIR dies, we and other organizations like us will spare no time in making efforts to put something on schedule - from house side or senate side.

    no it will not be voilation of the law at all. consider this scenario thats been going on for the last 30+ years. For example July 2006 visa bulletin for EB2 india was jan 2003 and the August 2006 visa bulletin for EB2 india was unavailable. EB2 india visa numbers might have already been used up when the August 2006 visa bulletin was released but they still accepted the AOS petitions filed until the end of July 2006, they did not issue an updated visa bulletin or a revised visa bulletin saying eb2 india numbers are used up and they will not accept eb2 india aos applications, they continued accpeting AOS applications until the end of july 2006.

    If you have the patience you can go through the visa bulletin archieves and find many such examples. The point is for the last 30+ years USCIS\DOS accepted applications according to the visa bulletin even when visa numbers were used up, they could have just followed the same precedent that they themselves set for the last 30+ years and accepted the applications this time as well without issuing a revised visa bulletin. I am no legal expert but that is how i see it.

    Absolutely, Those who filed in June 2006 had a visa number available which were exhausted by the month of Aug 2006. I am not saying that there is a one to one match between availability of visa number and adjudication of visa number. To be more clear, DOS and USCIS might have took 30K applications when there were 20k visa numbers. I am totally aware of this. How ever, all these went unnoticed because there was not a deluge of applications like this and USCIS did not care much about the extra 10K, who will wait until they are available. It could also be possible that they were doing this so randomly like they have done right now, with out proper communication and have not hurt each other. But the deluge of applications sure did bothered USCIS and hence they worked over time to exhaust numbers. As we all know, there is no rule to say that if there are 20K visa numbers, stop accepting applications once you reach 20K, they have to honor the VB for that month even though they get 200k applications. Thats why they exhausted the number by July 1st and when they could not complete by Jun 30th. I feel that USCIS will have a tough time answering

    a) How USCIS used the numbers before the start of the quarter, even though they are not authorized to?
    b) How USCIS approved some folks on July 1st , when the July VB is already effective?
    c) lastly the poor communication between agencies and the grievances suffered by every one involved, if at all.

    Can you let us know how did you search your case by? Website, what data do I need to pull the record? I dont have my labor copy with me. Also I dont know where my labor was filed.

    I searched my case on FLC data center and found following for my LC approval

    Employer_Job_Title = Computer Project Manager
    Prevailing_Wage_Job_Title = Computer Project Manager
    Prevailing_Wage_Level = Level II
    Prevailing_Wage_SOC_CODE = 11-9041.00
    Prevailing_Wage_SOC_Title = Engineering Managers
    Prevailing_Wage_Source = OES

    While I work as senior software/application developer in my current role with the same employer who filed my LC and GC.

    Now I am getting an offer from another employer with same title "Senior Software Engineer".
    Is it advisable to change job as my job code (job description) might be different from the one that was mentioned in LC?

I was researching some stuff & since you are from Fiji & with the political unrest in your home country, can you take political asylum since you were kinda forced to leave the country.     Thank you for your letter regarding the Development, Relief, and Education for Alien Minors (DREAM) Act of 2009 (S. 729). As always, I value your input on this and other issues, and strive to keep you updated on the important issues facing us today.

    On March 26, 2009, the DREAM Act was introduced by Senator Richard Durbin (D-IL). This bill would authorize the Secretary of the Department of Homeland Security to cancel the removal of, and give conditional permanent resident status to, an alien who entered the U.S. prior to his or her 16th birthday and has lived in the U.S. for a period of 5 years. Such a resident must also meet other requirements, such as be judged to be of good moral character, not inadmissible or deportable under the Immigration and Nationality Act, be admitted to a higher education institution or have completed high school or the equivalent, never been under a final order of deportation, and be under 35 years of age at the time of this Act�s enactment.

    Furthermore, the DREAM Act sets parameters for conditional permanent resident status, and the process by which one transitions from conditional to permanent residency status. Under S. 729, an undocumented alien would also be authorized to petition the Secretary for conditional permanent residency if that individual has satisfied all of the above requirements prior to the enactment of the Act. Currently, S. 729 is before the Senate Committee on the Judiciary where it awaits further consideration. While I am not a member of this committee, I will certainly monitor the progress of this bill.

    As you may know, Majority Leader Harry Reid (D-NV) announced on September 14, 2010, that he would offer the DREAM Act as an amendment to the Fiscal Year (FY) 2011 Defense Authorization bill (S. 3454) as well as not allow a fair and open debate on the bill. I was disappointed that he chose to play politics with necessary support for our troops and national defense by trying to tack on the DREAM Act, which is unrelated to the daily operations of the Department of Defense. I remain committed to reforming our legal immigration system and streamlining the legal process; however, I have consistently opposed proposals that extend taxpayer benefits to those here illegally or give incentives for illegal immigration. On September 21, 2010, the Senate voted 56 to 43, where 60 affirmative votes were needed, not to move forward with debate on the Defense Authorization bill. I joined colleagues from both sides of the aisle to oppose this vote.
