140K GCs were available on Oct 1 2005 and Oct 2006: categories were not current.
< 40K GCs were available on June 12 2007: all categories were current.
If there is a law to prevent acceptance of ALL AOS's on Oct 1 (when 140K GCs are available) then that law was violated on June 12 2007.
If there is no law to prevent acceptance of AOS's on June 12 (when < 40K GCs were available) then all categories should have been current on Oct 1 2005 and Oct 1 2006.

Hey I did 1 year of a PhD paying OUT OF STATE TUTION before I got a waiver with a research group in school. Majority of international students do not get assistantships to go to school. SO THEY PAY TUITION and TAXES after they start to work just like you Mr. GCsucks. You’re taxes go to the war effort and not to fund university research unlike tuition paid by international students. I got my receipt notices (485,765,131) yesterday. I had my 140 approved from Texas. Lawyer filed 485 package on July 17th to Texas. I got my receipt notices on 09/18/07 from Nebraska.

I guess USCIS has finally came up with the correct receipting procedure. As projected, every July-August 17 filers should be in the system by the end of the month.

My suggestion would be that probably doctors have discovered metastatic cancer and have give you the prognosis.
For your visa
It seems you have already cleared most hurdles
1) Talk to a immigration lawyer
2) Talk to USCIS and ask for "Humanitarian Expedite". Call or fax them the document ask you doctor to write the letter
3) get media attention: write to local congressman,senator and the local media TV stations to expedite your case
4)Dont delay any day. Once you create an expediate request they are bound to act on it.(by either rejecting it or accepting it). The point is make an official request without delay
In a similar situation i would try to straigten out few things
First is finance Security :
1)Try to transfer control and custody of all financial instruments to you wife name
2)is you wife working if not try to get job on H1b.(not EAD) Cap exempt HIB from university affialted jobs are alsways available or get her to a school on f-1
What does you wife want.She may not want to stay here if she does not have extended family.Talk to her.Ask here
Lastly Get an second opinion from Indian APollo etc they may do life prolonging surgical procedures (which doctors here might not be willing for many reasons ...this will get you enough time that your green card is appoved

Today I spoke to a Representative who deals with immigration issue at Sen Mike Dewine's (R-OH) office. I spoke to him for 15 minutes to understand what he and his senator think about this CIR.
Here is he and his senator feels about this bill. It is difficult for him to say that when CIR bill will be introduced in senate floor . It depend on Majority and Minority leaders to decide. Majority leader told to the media that he will introduce before the end of the may, he is mostly consistent, but there are several bills where he has committed a timeline and till today it is not on the floor.
However he told that once CIR pass, legal immigration is already taken care of, but if it does not passes there are bills like SKIL which will be put before the floor. But CIR has to fail or pass before you see this SKILL bill on the floor.

I am appalled by this development, but their is little in our control over this development. Evidently, it's repurcussion of mass conversion of EB3 to 2. But again that is not what we want to discuss over.

IV members - never lose control or temper - in a public rally. Be careful - remember, in this current scenerio we do not have much sympathy - if any official assualts us - more sympathy will be towards them.
Please do a thorough research on how effective rallies are based on our situation. We do not have much political support - no government support, no public support - and not the least of sympathy though we contribute so much.
In case of unanticipated actions - we may never know if politically we will have any help fro higher ups.
Also - please check the numbers ( remember though a lot of people show enthusiasm in discussion forums, in reality you will find very less people taking part)
So please do your homework and do a lot of discussion. Do not hurry up and rush into rallies. A lot of rallies are done by disciplined leaders who plan these well in advance.

Its good to see this thread is still active. I just came home after 30 hrs non-stop work due to our product launch. I did go through quickly on all the posts after my post and I really didnt get the point I was looking for. I will respond to each of you tomorrow in one post.
The response I see for any type of campaign in the form of contributions is pathetic, based on the number of people waiting and those who are active. We will go nowhere, but this must change, and we will help.
I will now have to sleep for 5 hrs and then go back.

I called my attorney today to inquire about this and he told me that one-third to one-fourth of the applications that he has filed in July are yet to receive the FP notices and he asked me not to worry about it.
Hope he is true and that we will be getting the FP notices soon.

I had long dely in gettting my 485/EAD/AP receipts from USCIS and I wrote to my local congressman. It really worked and got the receipt numbers from congressman office.
Try to write to your local congressman and explain your situation in one page.
