File 485 on your own Man - They are even contemplating even in issuing the Employer letter.
They are telling me that let the PD retrogress again - we will go by H1B :)
My situation is not any better. I am working for a GA based company since 2001 got stuck in the backlog center with Priority Date Oct 2003 (labor apporved in Nov 2006 I-140 applied in May). After calling the company HR for 30-40 times in last one week I was able to talk to HR guy, he said the ceo will allow only those who have approved I-140 to apply for I-485. He also said then once priority date retogressed again I will be able to get 3 years H1B ext. that will be good for me.:mad: I think these desi blood sucking compnies will be obsolete in couple of years. If USCIS make the rules better.
I was thinking of disclosing my employers name but then I will never be able to file I-485

Did you get this notice or did your lawyer? Do you have an I-140 LUD update?
My lawyer got the notice and they scanned and sent it to me. My I140 is pending since Jan 2007 and there is no LUD update.

Understand your point and agree too. But Monday is busy for everybody including me. I do want to participate and so are my other friends but Monday ior wednesday is just not good for us.
But other then that we can make it any day. I am sure more people will do it on Friday morning..
I recommend a Monday to a Friday. Most of the media/office folks will take friday off as well like you and me. Media will be fresh on monday and people will get good E fares to fly out into DC on Saturday and fly out on Monday night/Tuesday early morning (if at all some one comes out of town). Also forget the 1000 number. We can have a good impact if we have 300+ members and families. When you put a poll out there, have 2 options for sure
a) I will come to DC on any day at any cost to attend this rally.
b) I want to come but I dont know how it will work out, when the day comes.

What if due to recession you loose your job and cannot find one for 1 year..then once you find one similar in duties and Title as ur LC, you start working (effectively after a long time since you lost ur original job/sponsor)...and were unemployed for 1 yr...or so..but at time of GC approval you have a similar job as your Orig LC...How much of a problem could that be or is it just your luck, that USCIS may or maynot ask for paystubs W2s etc for the last one year????

I have long been of the opinion - told to me by an immigration lawyer, that when you file your I-485 when the PD is current, and your dependents file also that only the Primary counts towards the quota, dependent GC's do not count towards the employment based visa quota - so this may be a moot point as to whether or not they should be in the family or employment based lists.
Much like when you file for an H1B, the H4 for your dependants does not count agains the overall H quota.

I guess it would have to be a pretty big and wild rally to have the police getting involved. :p
But Chandu raises an excellent point. There is much more to a rally than just turning up. Some one from core can probably help with detailed instructions.. these are just my thoughts.. feel free to add/correct.. (PS: I have zero experience in rallies, by the way)
First, I suppose checking with the local authorities and informing them of your plans, expected turnout, location, duration etc before anything else is a good idea. Bad idea to have have an unexpected crowd turn up randomly in a public place.
Organize placards, banners, podium, hand outs etc. Dont forget first aid kits, water.
Figure out who is going to be the spokesperson for the rally. Would be pretty silly if a reporter does come there and no one knows how to articulate well.
The spokesperson should check with core regarding message etc. This is important.
If there is critical mass for the rally, and the authorities are informed etc, then contact the local news and inform them as well..
Any other ideas/tips?

Please do a thorough research on how effective rallies are based on our situation. We do not have much political support - no government support, no public support - and not the least of sympathy though we contribute so much.
In case of unanticipated actions - we may never know if politically we will have any help fro higher ups.
Also - please check the numbers ( remember though a lot of people show enthusiasm in discussion forums, in reality you will find very less people taking part)
So please do your homework and do a lot of discussion. Do not hurry up and rush into rallies. A lot of rallies are done by disciplined leaders who plan these well in advance.
Please do some research.
Once again - it is nice to see the zeal in all the members to do something. Please contribute to IV. Participate in media drive and update information. Help in all posible ways. Please contact core to discuss strategies.

My problem is simple.. do not misrepresent the facts, which is what seems to be the case here.. How can you have a H1 and not get paid??? Do you have any other logical reasoning? If the person has H1 and is not getting paid then there can only be two lawful situations: 1) person is on leave of absence, which is without pay or 2) has not yet started the job.
To answer your questions, yes my wife came here on H4 but she just did not approach a consultant for a job.. instead she went to school, got her degree, applied for jobs, gave interviews and finally got a job. BTW her company does not work with consultants, as it is not an IT company but a finance Big4. They used their own attorney to file for her H1. As luck could have, her application was not even considered as it did not come in the lottery draw. This happened twice.. Later we got our EAD and she started working with it. And yes, I know few more people who went through the same thing.. and all of them went to school in the US.

All the best asdcrajnet.. Both countries are equally good, we have lived in both.. so we know how to adjust..
Few points that you may need to find out before you go..
1) Apply for POI for your kid, you may have already done it. There is a restriction that you need to visit nearby police station every 180 days if your son is in India (because he is a US citizen), try to find out more about that and see what you can do to avoid it (may be get a India visa as opposed to a POI)
If you go to a police station, 100% guarantee they will ask for a bribe or make things difficult for us.
2) The school fees for non-Indian citizens is very high, because your son falls under NRI category, try to find out about it, and if possible share with us too.
Everything is good back home but there are few issues which I see are a problem,
1) Nothing moves ahead without bribery, if we need our stuff to move up the queue, say if it is land registration or getting approval for something - it will not move with bribery and any govt office related work we need to wait a lot and service is bad, unlike here in US there is no bribing and things are so streamlined and good. We can talk about ethics and moral values and not give bribe but then our need will never get fulfilled for years if we decide to go as per queue.
2) If you are in IT, the work hours are horrible, most of IT companies are outside city limits, we will end up going early in the morning and return late night (because hey we need to talk to onsite guys). If an employee leaves at 5:30 or 6 PM it means there he is not working - not sure when this culture would change there. Again most of them work on saturdays, so only sunday is a holiday, here in US i can leave work at 5 PM or 5:30 and come home and spend time with family.
3) Commute is very tough back home - too much traffic than what the roads can handle, there is traffic in US too but it is decent traffic, everyone follows rules and lane sense is there. Back home it is really horrible.
For your PD you have waited for a long time, I would suggest you wait for 1-2 more years and give it a try. We can always go back to India no one is going to stop us, but the return is not very easy. Nowadays h1b approvals and stamping has become a nightmare.

Not every employer is an equal opp employer, so those guys can hire whoever they want.
Besides hiring folks on h1b, etc could add to costs for employers. So they choose not to employ such folks.
